Yes and no. A DUI conviction carries penalties no matter if it is based on alcohol, marijuana, or other drugs. However there are differences. For example, illegal alcohol levels generally start at or above 0.08%. But any amount of active marijuana is illegal in Arizona when driving. Additionally, alcohol DUI penalties increase based upon the level of alcohol in the system, but there is no such increase for marijuana (or drug) levels.
