Do I Have to be High in Order to be Guilty of Marijuana DUI?

Yes and no. It is illegal to drive a car if you are impaired from marijuana, but the government has to prove it. There are many defenses to this type of arrest, including the tests that police use, or the driving behavior that occurred.
